Date of Last Revision: 13-May-2022

We know that most people skim terms of service at best because they’re full of legalese and jargon, but we have done our best to make this easy to understand. In each section we will summarize the most important takeaways, but these summaries are not legally binding, so please read the full version of the text for the details.

PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY CONTAIN AN AGREEMENT TO ARBITRATE AND OTHER IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS.

Welcome to The Guardians Program!

To summarize: by joining The Guardians Program you agree to these terms.

These terms of service cover The Guardians Program, and they apply to all users who participate in The Guardians Program provided through our website(s) located at https://finchcare.com/ (the “Site”) and through our mobile applications and related technologies (“Mobile Apps”). “We,” “our” or “us” refers to Finch Care Public Benefit Corporation and our subsidiaries. The Guardians Program comprises both the membership program that people subscribe to in order to become Guardians, and also the program that grants sponsored Plus memberships. “The Guardians Program,” “Guardians,” “The Guardians,” or “The Program” refers to this program and the related services offered by us. By using Guardians you agree to these terms and to the other policies we post, including without limitation our Finch Terms of Service and the policies listed below. Please read them carefully and let us know if you have any questions. For information about our data practices, please see our Finch Privacy Policy, as well as our Cookie Policy, The Guardians Privacy Policy, and the Example of Official Rules for Guardians Drawings. We can collect and use your information in accordance with those policies.

Your account

To summarize: You must be at least 13 years old to register for an account and participate in The Guardians. You are responsible for your account.

When you create an account or participate in The Guardians you must provide us with accurate information, in good faith, and you agree to keep your information updated if it changes. To create an account you must be at least 13 years old. To become a Guardian in The Guardians Program, or receive a sponsored Plus membership from The Program, you must be at least 18 years old or have your parent’s permission. You are responsible for anything that occurs when anyone is signed in to your account, as well as the security of the account. Please contact us at [email protected] immediately if you believe your account is compromised.

Abusive conduct

To summarize: Be responsible and do not violate our policies.

You are responsible for all activity on your account. If you violate our policies we may terminate your account. Don’t do anything illegal, abusive towards others, or that abuses our site or The Program in a technical way. These policies cover most issues, but if you find a new and creative way to hurt The Guardians Program or our community we may take action to prevent it.

All about being a Guardian

To summarize: A Guardian is someone who purchases memberships in The Guardians Program to receive the associated benefits. Through a membership, Guardians can contribute to our mission to help everyone feel happier and more supported each day.

As a member of The Guardians Program, you’re part of a group of kind people who want to give back to the community and support our mission to help everyone feel happier and more supported each day. Your membership also includes special benefits, which may include access to our team, exclusivity, gifts, and other perks. In exchange, you pay us for membership programs, on a subscription basis, to receive the associated benefits.

The timing and amount of each membership subscription depends on the type of membership agreement you enter into. You can see the details as you join The Program and on The Guardians FAQ.

To become a Guardian, simply select your preferred membership, and complete the checkout process on Stripe. We use Stripe to store and manage your payment and related membership details. You can view Stripe’s privacy policy and other related policies here.

You may cancel your membership payments at any time. Annual memberships may be cancelled, or increased, but not lowered. Terminating or lowering the tier support of membership will go into effect in the subsequent (not current) payment term, except for annual memberships which can be terminated or increased but not lowered. Increasing your payment to a higher tier level in an annual membership will go into effect in the current payment term. When you increase your payment for an annual membership during the term, you will get a credit for any payment already made in that term.

For monthly payments, canceling your support may result in your loss of access to membership benefits at the end of the current payment term. Please see The Guardians FAQ for more details.

These include when you cancel your membership subscription, or your payment method fails.
